Plain language summary
Tapimo is an Australian hospitality ordering platform. Venues use it to accept QR-based orders from their tables, and customers use it to scan, browse, order and pay. By using the service you agree to use it responsibly, accept that Tapimo charges per-order fees and (where applicable) subscription fees, and accept that disputes are governed by Australian law.
1. Acceptance of terms
By creating a Tapimo account, placing or accepting orders through the platform, or accessing any portion of the service, you agree to be bound by these Terms of Service and the Privacy Policy.
2. The service
Tapimo is a multi-tenant table-based ordering platform that connects diners (customers) with hospitality venues (operators). Tapimo is the platform; the venue is the merchant of record for the food and beverages purchased.
3. Venue obligations
- Operate the venue in compliance with applicable Australian law, including food safety, responsible service of alcohol, and consumer protection.
- Maintain accurate menu listings, pricing, allergens and availability.
- Settle disputes about food quality, missing items and refunds directly with the customer; Tapimo will assist via its merchant tooling.
- Pay any applicable taxes (including GST) and maintain valid ABN registration where required.
4. Customer obligations
- Use the service for personal, non-commercial purposes.
- Do not attempt to circumvent the QR-based table session model.
- Pay for any orders placed.
5. Fees and payments
Subscription fees and per-order platform fees are listed on the pricing page and are subject to the rates of the plan a venue is on at the time of each transaction. Stripe processing fees apply separately and are charged by Stripe directly to the venue's connected account.
6. Refunds
Refunds for individual orders are issued by the venue through the Tapimo dashboard. Subscription refunds are governed by the cancellation policy: venues may cancel at any time and the venue remains active until the end of the current billing period.
7. Suspension and termination
Tapimo may suspend or terminate venue accounts that violate these terms, including but not limited to fraudulent activity, repeated chargebacks, breaches of Australian law, or failure to maintain a valid payout method.
8. Liability
Tapimo provides the platform on an as-is basis. To the extent permitted by Australian law, Tapimo's liability for any claim is limited to the platform fees paid by the venue in the three months preceding the claim. This limitation does not exclude rights under the Australian Consumer Law.
9. Governing law
These terms are governed by the laws of Western Australia, and any disputes are subject to the exclusive jurisdiction of the courts of Western Australia.
10. Changes
Tapimo may amend these terms by publishing a new version. Venues will be notified of material changes and given a reasonable window to review before the new terms take effect. Continued use of the service after the effective date constitutes acceptance.
